Answer
Introduction
Criminal investigation is the collection of evidence for identifying, apprehending and convicting the criminal. The term "investigation" comes from the Latin word investigare, which means to look for or search into something. It follows these principles: establishing the crime scene, closing the entry and exit of the location, and communicating with the departments concerned for possible lines of action. Primary and secondary walks are made to collect evidence, and in the end the evidence is presented in the court of law.
Objectives of criminal investigation
Criminal investigation has many objectives, achieved through specified tasks given to specific persons: (1) examine the entire crime scene; (2) reconstruct the crime scene; (3) the investigation officer (IO) and his team identify the method by which the criminal committed the crime; (4) find the motive (mens rea) behind the crime; (5) collect evidence to identify the criminal; and (6) present strong evidence in the court of law to convict the offenders.
Principles of criminal investigation
1. Establishing the crime scene dimensions. The crime scene is the first step of the criminal investigation. Its dimensions are established to locate the culprit's entry and exit. The crime scene is cordoned off to protect the evidence, and precautionary measures should be taken to seal it.
2. Taking possible lines of action for finding evidence. After the crime scene is cordoned off with yellow tape, possible lines of action should be taken for collecting evidence. According to Locard's exchange principle, anyone entering or leaving the place of a criminal act brings something in and takes something away, which can alter the evidence.
3. Primary walk of the crime scene and documentation of the evidence. Primary walks take place to identify and check the place for gathering evidence. All items are checked carefully, and the IO collects the evidence with care, whether it is biological or electronic.
4. Secondary walks of the location for collection of evidence. After the place has been seen, secondary walks are made to collect any evidence not yet collected. This evidence is collected carefully and preserved. The entire crime scene is searched thoroughly, and the evidence to be presented in court is secured.
5. Sending evidence to the related departments for identification of the culprit. After collection, every piece of evidence is sent to its related department to identify the culprit involved in the criminal act. This helps the IO locate the offender behind the crime.
6. Presentation of evidence in the court of law. The final police report (challan) is submitted in court under Section 173 of the CrPC. The evidence is presented to prove the guilt of the accused. When guilt is proved, the criminal is sentenced to imprisonment according to the type of crime he committed.
How these principles contribute to the success of an investigation
(a) Securing the crime scene prevents loss of evidence. These principles help protect the items at the crime scene. They prevent evidence from being lost from its place and increase transparency during the investigation.
(b) Documentation of the entire crime scene. Documentation is a key principle of criminal investigation. Everything available at the crime scene is collected, gathered and preserved, then documented and kept in custody as evidence to be offered in the court of law.
(c) Higher conviction rate by developing a chain of custody. The principles produce a chain of custody for identifying the criminal. This raises the conviction rate through the apprehension of criminals, and the principles present the whole scenario of the crime in court.
(d) Identifying real offenders and protecting innocent people. Criminal investigation helps identify the real offenders. It protects witnesses and innocent people from conviction, ensures justice for victims, and secures the evidence.
Conclusion
"Criminal investigation is the art of discovering truth," according to Charles E. O'Hara. Many principles guide the IO towards an effective investigation. It starts with establishing the crime scene dimensions. The location is then cordoned off with yellow tape, and the police communicate with other officers and departments to take action. Primary and secondary walks are made to collect and preserve evidence, and in the end the evidence is documented and presented in court. These principles make investigations effective by protecting the crime scene, bringing transparency to the investigation and apprehending criminals for the welfare of society.
